Welcome to ETDelivery.com (“we,” “our,” “us,” or “ET Delivery”). By accessing or using our website, mobile app, or services (“Platform”), you agree to be bound by these Terms and Conditions. If you do not agree, do not use our services.
1. Service Description
ET Delivery is a third-party logistics platform connecting customers with independent delivery contractors. We do not own or operate delivery vehicles nor employ drivers directly. All deliveries are performed by independent contractors (1099 workers).
2. User Eligibility
You must be at least 21 years old to use our services. By using the Platform, you represent and warrant that you meet all eligibility requirements and have the legal authority to enter into these Terms.
3. Account Registration
To use some features of ETDelivery.com, users may need to create an account. You agree to provide accurate and complete information and to keep this information updated. You are solely responsible for all activity under your account.
4. Delivery Terms
- Delivery Areas: We currently operate in designated service areas shown during checkout.
- Delivery Times: Estimated delivery times are not guaranteed and may vary.
- Customer Responsibilities: You must provide accurate delivery information and be available to receive deliveries. Missed deliveries due to incorrect or incomplete information are not our responsibility.
- We do NOT deliver to the following RESTRICTED LOCATIONS:
- Public or private school
- Hospitals & health care facilities
- Sports venues or any place hosting a sporting event
- College campus or student living
- Prison, reformatory, veterans’ home, or state capitol grounds
- P.O. Boxes
- Locker or similar package storage service
- Other business that sells tobacco products
5. Driver Relationships
ET Delivery contracts with independent drivers. These drivers are not employees, agents, or representatives of ET Delivery. We are not liable for the actions or omissions of drivers.
6. Payment & Fees
- Service Fees: Fees vary by delivery size, distance, and urgency.
- Payments: All payments are processed through our platform. You agree to pay all applicable charges at the time of order.
- Refunds: Refunds are issued at our sole discretion, based on circumstances such as failed deliveries or cancellations.
7. Prohibited Items
We do not deliver:
- Controlled substances (unless permitted by law)
- Firearms or explosives
- Perishables without proper packaging
- Live animals
- Any item prohibited by federal, state, or local law
If an item is deemed prohibited, delivery will be refused, and no refund may be issued.
8. Limitation of Liability
To the fullest extent permitted by law, ET Delivery shall not be liable for indirect, incidental, or consequential damages arising out of or related to your use of our services. We do not guarantee the availability, accuracy, or performance of the Platform.
9. Indemnification
You agree to indemnify, defend, and hold harmless ET Delivery, its officers, directors, employees, and contractors from any claims, damages, liabilities, and expenses arising from:
- Your use of the Platform or services
- Your violation of these Terms
- Your violation of any third-party rights
10. Intellectual Property
All content on the Platform, including logos, trademarks, and software, is the property of ET Delivery or its licensors. You may not use, copy, or distribute any content without our express written consent.
11. Termination
We may suspend or terminate your access to the Platform at any time, for any reason, including breach of these Terms. You may also cancel your account at any time.
12. Governing Law
These Terms are governed by the laws of the State of Texas, without regard to conflict of law principles. Any legal action must be brought in the courts located in Travis County, Texas.
13. Changes to These Terms
We reserve the right to update or modify these Terms at any time. Changes are effective immediately upon posting. Continued use of the Platform after changes means you accept the new Terms.
